New York’s power of attorney framework is not a single form. It is a coordinated set of documents, each governing a distinct domain of authority. Below is every instrument our office handles, with a brief explanation of its legal function under New York law.

The Statutory Short Form Power of Attorney (GOL §5-1513)

The foundation of any NY estate plan. Effective June 13, 2021, major amendments to New York General Obligations Law §5-1513 reformed execution requirements and eliminated the outdated Statutory Gifts Rider. Today, gifting authority — including gifts exceeding the $5,000 annual aggregate threshold — lives in the Modifications section of the form itself.

Durable Power of Attorney

Under New York law, a POA is durable by default: it remains effective even if the principal later becomes incapacitated, unless the document expressly says otherwise. This is the instrument most families need. It takes effect immediately upon execution and survives incapacity without any additional proof or court involvement.

Springing Power of Attorney

A springing POA activates only on a stated future event — most commonly, the principal’s incapacity. While useful in limited planning contexts, it carries a practical burden: the triggering event must be established to the satisfaction of every third party asked to act on it, which often slows or blocks urgent financial decisions. We counsel clients on when this instrument is appropriate and when a durable POA better serves their goals.

A financial POA does not cover medical decisions. For healthcare authority, New York requires a separate document: the Health Care Proxy. We prepare this alongside financial POA instruments so your plan is complete.

Execution Requirements at a Glance

Every NY POA we prepare satisfies the 2021 amended execution standards under GOL §5-1513:

Notary acknowledgment Same standard as a real-property conveyance
Two disinterested witnesses The notary may serve as one; the named agent may NOT witness
Substantial conformity to §5-1513 Exact wording no longer required; conforming forms receive third-party safe harbor
Gift authority Up to $5,000/year aggregate without modification; larger gifts or gifts to the agent require an express Modifications grant

The 2021 safe-harbor provision is why conforming documents are now honored more reliably by New York banks and financial institutions — provided the form is drafted correctly.
